Interference with Commerce by Robbery

Before a person can be convicted of the federal crime of interference with commerce by robbery, the prosecution must prove the following three things beyond a reasonable doubt:

1. The accused individual knowingly obtained or took the personal property of another, or from the presence of another, as charged;
2. The accused person took the property against the victim’s will, by means of actual or threatened force or violence or fear of injury, whether immediately or in the future; and
3. That, as a result of the accused individual’s actions, commerce, or an item moving in commerce, was delayed, obstructed or affected in any way or degree.
