False Identification Documents

Before a person can be convicted of the federal crime of false identification documents, the prosecutor must prove the following three things beyond a reasonable doubt:

  1. The person charged possessed five or more false identification documents;
  2. The person charged possessed five or more false identification documents knowingly and willfully with the intent to unlawfully transfer the false identification documents; and
  3. The possession of the false identification documents was in or affecting interstate or foreign commerce.
